Representative Cases
- Plaintiff claims to have been an employee of defendants on DOI, when the tractor he was operating on Defendants' premises rolled over, resulting in injuries to his back and legs. Plaintiff further claims that Defendants were illegally uninsured for CA workers' comp., thereby resulting in a rebuttable presumption of negligence against Defendants and excluding any evidence of comparative negligence on Plaintiff's part. {CA Labor Code sec's. 3700, et seq.} Defendants deny that plaintiff was their employee, claiming that plaintiff was an independent contractor, and that plaintiff either intentionally rolled the tractor out of spite, and/or that plaintiff was not operating the tractor within the scope and in the course of any employment with defendant. Defendants further claim that plaintiff is exaggerating his injuries and damages. Defendants' insurance carrier has denied coverage of any kind for this matter.
- Minor burned by stove which allegedly spontaneously started, or did not shut off due to allegedly non-functional control.
- Slip and fall in liquid on floor in retail store allegedly leading to surgical knee replacement. Case settled after mediation following repeated follow up from the Mediator.
- Member of Steering Commission for NFL brain trauma litigation, representing several dozen plaintiffs or their families.
- Plaintiffs’ Liaison Counsel for latex protective gear litigation.
- Intra-ocular lens litigation.
- Serious injury automobile accident case, in which a nonagenarian pedestrian was run over by another nonagenarian while the latter was attempting to parallel park on a city street. Resolved for over $1.4 million.
- Handled a complex auto vs. auto case involving issues of rental agency liability, CA Probate Code sections 550, 552, and 9390, as well as allegations of fraud.
- Handled several sexual abuse of minor cases, including one in which plaintiff is aphasic and A.S.D.
- Handled a three-week jury trial of an automobile defect injury case; defense verdict.
